RENTAL AGREEMENT FOR FALLS CREEK (RETREAT ONLY)

(Yukon Church rental agreement 2008)

WHEREAS,
the First Baptist Church of Yukon, Oklahoma (the “Church”), acting upon the recommendation of the Falls Creek Committee of the Church, does hereby enter into this Rental Agreement with the Joint Chinese Baptist Church, having an address of 3219 Wellington Rd, in the City of Carrollton, State of Texas (the “Tenant”), for the rental of the Church’s cabin located at Falls Creek Conference Center, Davis, Oklahoma (the “Cabin”), for the date of August 29, 2008, through August 31, 2008, (the “Rental Period”), under the following terms and conditions:

1. The rental fee for the use of the Cabin is Eight Hundred Dollars ($800.00) per night. The total rental fee of One thousand six hundred ($1,600.00) (the “Rental Fee”) must be paid at least two (2) weeks before the first day of the Rental Period.

2. A liability deposit of Five Hundred Dollars ($500.00) (the “Liability Deposit”) must be paid at the time of signing this agreement.

The Liability Deposit is to be held by the Church until the Cabin has been inspected by a person authorized by the Church and any and all repair invoices have been submitted to the Church; at which time the Liability Deposit will be refunded to the Tenant, with the following expenses subtracted:

cleaning fee, check-in and check-out fees, any fees related to the preparation of the Cabin for rental, including, but not limited to, de-winterizing and re-winterizing, and any and all costs of repairs for damages caused by Tenant’s action, mistake or inaction. Ordinary wear and tear will not be taken out of the Liability Deposit.

IT IS FURTHER AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS:

1. The Church hereby agrees as follows:

a. All equipment and appliances in the Cabin will be in working condition;

b. All utilities will be paid; andc. The Church is not responsible for any personal injury or loss of personal effects.

2. The Tenant hereby guarantees and agrees as follows:

a. To pay the Rental Fee as stated above;

b. To maintain good housekeeping habits with respect to the Cabin and related facilities;

c. To abide by all rules of the Falls Creek Conference Center and all Cabin rules as listed on any attachments hereto and/or as posted in the Cabin;

d. The Cabin will not be sub-rented to a third party;

e. To be responsible to the Church for any and all damages to the Cabin, including, but not limited to, the building, furniture, appliances, equipment and supplies; and in the event that the Liability Deposit is not sufficient to cover the cost of repairing any damage caused by the Tenant, do hereby indemnify and hold harmless the Church for the full damages sustained, and agree to reimburse the Church for any and all amounts exceeding the Liability Deposit immediately upon receipt of a bill for such damages;

f. To furnish to the Church evidence of insurance coverage for all persons who will be using the Cabin;

g. To furnish the Tenant’s own eating utensils (knives, forks, spoons, etc.);

h. The Church is not responsible for any personal injury or loss of personal effects; and

i. To register with the Falls Creek office, immediately upon arrival, and pay directly to the Falls Creek office $3.00 per person per calendar day for registration fees.

3. Either party may cancel this agreement by notifying the other party no later than forty-eight (48) hours prior to the first day of the Rental Period. In the event this agreement is cancelled by the Tenant, the Rental Fee and the Liability Deposit will be refunded, LESS any applicable fees incurred relating to the preparation of the Cabin for rental, including, but not limited to, de-winterizing and re-winterizing. In the event this agreement is cancelled by the Church, the Rental Fee and the Liability Deposit will be refunded in their entirety.

4. No money shall be refunded to the Tenant after the Tenant has occupied the Cabin during the Rental Period, excluding the provision hereinabove regarding the Liability Deposit.

5. The persons executing this agreement hereby state and affirm that they are representatives of the respective parties and are fully authorized by the respective parties to act on behalf of the parties.
